1 Acceptance of these Terms
These Terms of Service ("Terms") are a legal agreement between you — whether you are an individual, a company, or another organization ("you", "your", "Customer") — and FinOps Control ("we", "us", "our").
By visiting our website, creating an account, starting a free trial, or subscribing to the platform (together, the "Service"), you agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you confirm that you have the authority to bind that entity, in which case "you" refers to that entity. Because our customers use the Service from countries around the world, these Terms are written to apply consistently regardless of where you're located, subject to Section 17.
If you do not agree with any part of these Terms, please do not use the Service and let us know at support@finopscontrol.com so we can address your concerns.
2 Who we are
FinOps Control is an independent cloud cost management platform that helps teams track, forecast, and reduce what they spend on AWS, Microsoft Azure, and Google Cloud. Our contact details are set out in Section 20 below.
3 The Service
The Service gives you visibility into your cloud spend across the accounts you connect, along with tools to identify savings opportunities, track budgets, and receive alerts on unusual cost activity. The exact features available to you depend on your subscription plan, as described on our pricing page or in your order confirmation.
We may update, improve, or discontinue features of the Service from time to time. Where a change materially reduces the core functionality you are paying for, we will give you reasonable advance notice.
4 Eligibility & accounts
You must be at least 18 years old and capable of entering into a binding contract to use the Service. If you register an account with us, you agree to provide accurate information, keep your login credentials confidential, and notify us promptly at support@finopscontrol.com if you suspect unauthorized use of your account. You are responsible for activity that happens under your account, except to the extent it results from our failure to meet our own security obligations.
5 Free trials & subscriptions
We offer a Free Plan of the platform. No credit card is required to get started. Once your trial or usage limit is reached, you can upgrade to a paid plan, billed on a monthly subscription basis.
Paid subscriptions are billed monthly and continue until cancelled. You can cancel your subscription at any time from within your account or by writing to us at support@finopscontrol.com. When you cancel, your subscription remains active through the end of the monthly billing period you've already paid for, and access ends at the close of that period. Cancellation does not entitle you to a refund for the current billing period, except as required by law or as separately agreed with you.
6 Fees, invoicing & taxes
Fees for the Service are set out on our pricing page or in your order confirmation. Unless stated otherwise, fees are quoted exclusive of any applicable tax or duty, which will be added to your invoice where it applies to your location or ours.
Invoices are payable within the period stated on the invoice. We may suspend access to the Service if payment is significantly overdue and you have not resolved this after we have given you written notice.
7 Connecting your cloud accounts
To provide cost visibility and recommendations, the Service needs read access to billing, usage, and resource metadata in the cloud accounts you connect. You are responsible for granting only the access you intend to give, for the accuracy of the accounts and data you connect, and for managing user access to your FinOps Control account within your own organization. Cost-saving or rightsizing recommendations produced by the Service are decision support — you remain responsible for reviewing them before acting on them, since only you have full context on how a given resource is actually used.
8 Acceptable use
You agree not to use the Service to: break any applicable law; infringe someone else's intellectual property or privacy rights; introduce malware or attempt to gain unauthorized access to our systems or another customer's data; reverse-engineer the platform except to the extent expressly permitted by law; or resell or sublicense access to the Service without our written agreement.
We may suspend or restrict access where we reasonably believe this section has been breached, and will let you know why where we are able to.
9 Intellectual property
We retain all rights in the FinOps Control platform, including its software, design, and underlying methodology. Nothing in these Terms transfers ownership of that technology to you. You retain ownership of your own data and materials, as described in Section 10. If you give us feedback or suggestions about the Service, we may use them to improve the Service without any obligation to you, unless we agree otherwise in writing.
10 Your data & confidentiality
You retain ownership of the business data, content, and cloud account data you connect to the Service ("Your Data"). We will only use Your Data to provide the Service, to comply with the law, or as you otherwise permit. Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
Each party agrees to keep the other's confidential business information private and to use it only for the purpose of the engagement, unless disclosure is required by law or a competent authority.
11 Third-party services
The Service builds on and integrates with third-party infrastructure, including AWS, Microsoft Azure, and Google Cloud. While we choose these providers carefully and design our own systems to be resilient, we do not control their availability, and we are not responsible for outages, changes, or issues that originate with a third-party provider outside our reasonable control.
12 Warranties & disclaimers
We will provide the Service with reasonable skill and care, consistent with good industry practice. Beyond that, and to the fullest extent permitted by law, the Service is provided "as is" and "as available," without additional warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise that the Service will be uninterrupted, error-free, or that every cost-saving recommendation it produces will be suitable for your specific situation — these outputs are decision support, not a guarantee of results or savings.
13 Limitation of liability
To the fullest extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, or consequential loss (including loss of profits, revenue, or data) arising out of or related to these Terms or the Service.
Each party's total liability arising out of or relating to these Terms, however caused, will not exceed the total fees paid or payable by you to us for the Service in the twelve (12) months before the event that gave rise to the claim. Nothing in these Terms limits either party's liability for fraud, gross negligence, or anything else that cannot lawfully be limited or excluded.
14 Indemnity
You agree to indemnify us against reasonable losses and costs we incur as a result of your material breach of these Terms, your misuse of the Service, or your violation of applicable law, except to the extent caused by our own breach or negligence.
15 Term, suspension & termination
These Terms apply for as long as you use the Service. A subscription can be cancelled as described in Section 5. We may suspend or terminate access where you materially breach these Terms and do not correct the breach within a reasonable period after we notify you, where required by law, or to protect the security of our systems or other customers. On termination, your right to use the Service ends, though sections of these Terms that by their nature should survive (for example, intellectual property, confidentiality, and limitation of liability) will continue to apply.
16 Force majeure
Neither party will be responsible for delay or failure to perform its obligations (other than payment obligations) caused by events beyond its reasonable control, such as natural disaster, government action, internet or utility outage, or similar circumstances, for as long as that event continues.
17 Governing law & disputes
These Terms are governed by the laws of the country in which FinOps Control's operating entity is legally registered and headquartered, without regard to conflict-of-law principles. Subject to any specific dispute resolution clause agreed in a signed order form or agreement, the courts having jurisdiction over that place of registration will have exclusive jurisdiction to hear any dispute that cannot be resolved between the parties informally.
Before starting formal proceedings, both parties agree to first try to resolve any dispute in good faith through direct discussion between authorized representatives.
18 Changes to these Terms
We may update these Terms from time to time, for example to reflect a new feature, a change in the law, or feedback from our customers. If we make a material change, we will post the updated Terms on this page with a new effective date and, where appropriate, notify active subscribers by email. Continued use of the Service after a change takes effect means you accept the updated Terms.
19 General terms
These Terms, together with any order confirmation and our Privacy Policy, form the entire agreement between you and us on the subject matter covered. If any provision is found unenforceable, the rest of these Terms remain in effect. Our failure to enforce a right is not a waiver of that right. You may not assign your rights under these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. Formal notices to us should be sent to the address in Section 20.
